AGREEMENT TERMS

 

This Afterlife LLC Installment Agreement ("Agreement") sets forth the conditions under which you, the borrower, are granted access to our buy now, pay later service. Engaging in a transaction with a merchant via Afterlife LLC's service signifies your acceptance of this Agreement's stipulations, including the provided Final Payment Schedule. This schedule delineates your initial down payment, the series of installment payments, and their respective due dates, and it supersedes any prior payment schedules.

 

Eligibility Criteria: 

To apply for and enter this Agreement, you must be at least 18 years old. 

 

Definitions:

• "You" and "your" refer to you, the borrower.

• "We," "us," and "our" denote Afterlife LLC or its successors.

• "Merchant" is the provider of goods or services you aim to purchase.

• "Payment Method" is the payment option you choose to utilize.

 

1.     Use of Proceeds and Disbursement Authorization: Upon this Agreement's acceptance and the completion of your purchase, you empower us to forward payment to the merchant on your behalf. You commit to repaying these funds in line with the Final Payment Schedule, which outlines any upfront payment and subsequent installment payments.

 

2.     Installment Payments: You will opt for a preferred Payment Method and consent to make four (4) installment payments, as specified in your Final Payment Schedule. It is your responsibility to ensure the availability of adequate funds for each scheduled payment.

 

3.     Late Payments and Fees: This Agreement does not impose interest rates. However, for each installment payment there is a service charge as according to our fee structure, furthermore if a payment is not made by its due date, a late fee will be applied, as outlined in your Final Payment Schedule, adhering to applicable legal standards.

 

4.     Delinquency and Default: Failure to meet payment obligations on time can result in delinquency or default, which allows for the implementation of specific measures to address the outstanding debt. These actions may include pursuing legal remedies such as filing a claim in small claims court or civil court to recover the owed amount.

 

5.     Approval and Cancellation: All applications for credit are subject to our review and approval. We reserve the right to decline your application or revoke an approved application under specified conditions, thoroughly explained herein.

 

6.     Reasons for Application Denial: Your application may be declined for various reasons, including:

• Current or past due debt obligations

• Non-medical debt collections

• Negative public records, recent bankruptcy, or property repossession

• Low credit score, using TransUnion VantageScore, with a VantageScore 4.0 below 661

 

7.     Pre-Authorizations: As part of our approval procedure, we may execute a pre-authorization on your Payment Method, which entails a temporary hold on funds. This hold is released upon the transaction's completion or its cancellation.

 

8.     Merchandise Refunds and Adjustments: The merchant's policies govern refunds and exchanges. You are obligated to continue payments under this Agreement unless a refund is directly issued to us, prompting an adjustment to your payment responsibilities.

 

9.     Transfers or Assignments: We retain the right to transfer or assign this Agreement and any related rights to a third party without requiring your agreement.

 

10.     Complaints and Disputes: We encourage you to reach out to us directly with any complaints regarding this Agreement or the acquired goods. Dispute resolution will follow the procedures specified in this section, including any agreement to arbitrate.

 

Incorporation of Terms: This Agreement includes the terms and conditions outlined in Afterlife LLC's Terms of Service and Privacy Policy, as available on our website. In the event of any discrepancy, the provisions of this Agreement take precedence.

 

Acceptance: By utilizing Afterlife LLC's services, you acknowledge and agree to the terms set forth in this Agreement.
